General
I retain the rights to the commissioned piece and/or character design artwork drawn by myself. This means I can post and use the artwork as an example on any social platform and market myself using said artwork. This also means you cannot use the work for profit UNLESS you have paid an additional fee for the right, and have written permission from me. Details of such situations are in the “Use” section.
I do not consent to having my work fed into any “Artificial Intelligence” image generation programs.
I do not consent to have my character designs or commissions made into non-fungible tokens (NFTs) or sold for cryptocurrency.
Tracing, highly referencing, or intentionally copying my work and/or character designs is prohibited.
I reserve the right to refuse an attempted purchase of a commission and/or character design without disclosing any reason.
Upselling of any of my character designs is prohibited unless additional effort is put into said design, such as, but not limited to, additional artworks added to the character’s gallery and/or additional written lore.Payment
Full payment up front. For commissions or character designs over $100, payment plans can be arranged and made in installments. Should the commissioner cancel a commission, refunds will NOT be given. No matter what stage the piece is in, it will be given to the client following cancellation.Process
Communication is done through Toyhouse, VGen, Email, or Discord Fill out the request form, providing as many details about your character as possible as well as any possible references, poses, or expressions. Keep in mind that you're commissioning me for my style and artwork; suggestions for the piece to be done in a certain style will be ignored, and your commission may be declined. Any references containing generative AI will result in the commission being declined and you being blacklisted and blocked. Links to a character's Toyhouse profile (or wherever you store character information) are helpful and appreciated. You're allowed up to three major revisions during the sketch phase, anything after the sketch phase may incur extra fees. Any revision requests after the three initial requests may also incur extra fees. Be clear and concise about what you want from the get-go. Frequent progress updates will be provided during our communication and commission process. Ask for updates anytime, but keep in mind my work schedule and availability. Work schedule and availability may be subject to change– if such change occurs, you’ll be notified as soon as possible.Use
Use of the commissioned piece and/or character design is agreed on as early as the initial request, but should the client decide to use it for something other than personal use, additional payments can be made later.
Types of Use
Personal: Artwork is collected for a character's gallery and character design is used in any nonprofit circumstance such as roleplay and personal enjoyment. There will be no price increase in such circumstances.Streaming: If the artwork and/or character design is to be utilized in any streaming form such as but not limited to Twitch or YouTube, the price will be inflated accordingly as it's possible to earn a profit using the piece. Use includes certain screens/scenes in the stream, stream mascots or personas, channel profile pictures, etc. The increase is +75% of the final calculated price AFTER all of the add-ons.Commercial: Commercial use of a piece includes being used for corporations/organizations/individual business endeavors. This includes professional studios creating games, comic/webtoon works, merchandise, etc; anything in which a continuous monetary gain is collected.The increase is +150% of the final calculated price AFTER all of the add-ons.Should the piece or character design be discovered to be used in any for-profit situation without the extra payment for the rights and written permission, the buyer will be asked to provide the payment within the next 7 days. Should the buyer refuse, them and anyone associated with the buyer (fellow corporation and organization members, stream mods, etc;) will be permanently blacklisted from purchasing from me in the future. Please be clear about usage and, if you’re confused about which type of use applies to you, ask questions. There are no stupid questions– Transparency is key.By commissioning me, you automatically agree to these terms.
